SolarMAX Beautiful Moments
World Photography and Essay Contest
SolarMAX Technology Inc., LA Primetime TV and Arcadia Medical and Cosmetic Center are proud to present the Beautiful Moments World Photography & Essay Contest. This following is a summary of the official rules. The complete official rules can be found on the LA Primetime TV website at www.primetimetv.org.
We welcome anyone who is at least 18 years of age to submit a photo of a particularly touching, beautiful moment he/she has personally shot and edited. Acceptable themes include, but are not limited to, the following: family, love, overcoming challenges, humankind’s technological or cultural achievements, notable personal or public events, nature, and animals.
The Top 50 winners will be announced on May 28, 2018 and each winner will receive a “Certificate of Excellence Award.” The Top 10 winners will be announced on June 5, 2018 and each winner will receive, in addition to a certificate, a “Top 10” trophy and $200 (unless they are also a Top 3 winner). The Top 3 winners will be awarded a certificate, a first, second or third-place trophy, and one of these cash prizes:
The Top 10 winners will also be invited as guests of honor to the annual AHMC Health Foundation Gala, to be held on June 23, 2018 at the Westin Bonaventure Hotel in Los Angeles. The top three winners will be announced at this event. All prizes will be awarded no later than July 15, 2018.
HOW TO ENTER
Participation Criteria: Entrants must be at least 18 years of age and are allowed to use cameras, cell phones, and other electronic devices. Professionals and amateurs are welcome. No purchase is necessary to enter.
Judging Criteria: Entries are worth 100 points total (photo 50 points/essay 50 points)
Submission Criteria: Participants must send an email to firstname.lastname@example.org stating their full name, age, email address, phone number and mailing address (P.O.Box is not acceptable), and attach the following:
One photo (JPEG/JPG format, 15 MB or less). Only one photo is permitted.
An essay of 200-500 words (English or Chinese) describing the beautiful moment in the photo.
A brief description of the camera or other device used, the settings, such as the shutter speed, aperture, or effects, and editing methods, including any editing software used.
Submission Deadline: May 18, 2018 (11:59 p.m. PST).
Participation Prohibited: Employees, officers, interns, and directors of Sponsors and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live), or persons living in the same households of such individuals, whether or not related, may not enter or win a prize. Contest void where prohibited by law.

Entrants retain all rights to any photos submitted; however, by submitting a photo, Entrants grant Sponsors and their successors, assigns and licensees, a royalty-free, non-exclusive license to reproduce, distribute, display, broadcast, modify and create derivative works of the photo in any media now, or hereafter, known.
Entrants agree to indemnify and hold Sponsors, and all others involved in the administration of this contest, harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any plagiarism, copyright infringement or any other violation, or alleged violation, of any third party’s rights.

The Beautiful Moments™ World Photography and Essay Contest begins March 5, 2018 and ends May 18, 2018 (the “Entry Period”). The deadline by which entries must be received is 11:59 p.m. (Pacific Standard Time) on May 18, 2018. Entries will not be acknowledged. Information on participation are part of these official rules (“Official Rules”). This is a skills-based contest and chance plays no part in the determination of winners. No purchase is necessary to enter and a purchase will not improve your chance of winning.
This contest is sponsored by SolarMax Technology Inc., and the Arcadia Medical & Cosmetic Center (AMCC), and LA Primetime TV is the contest organizer.
AHMC HEALTH FOUNDATION GALA/AWARDS RECOGNITION CEREMONY
Each of the top 10 winners will be invited as guests of honor to the AHMC Health Foundation Gala to be held on June 23, 2018 in Los Angeles. The top 3 winners will be announced in a special awards recognition ceremony during this event. Transportation and accommodations will not be provided. All prizes will be awarded no later than July 15, 2018. Attendance is not required for prize consideration and attendance or non-attendance will have no impact on the judging of entries.
WHO MAY ENTER
The contest is open to entrants (“Entrants”) that are at least 18 years old on March 5, 2018 and that are otherwise eligible to participate in this contest in accordance with all applicable laws and all of these Official Rules. Professional and amateur photographers are welcome to participate.
WHO MAY NOT ENTER
Employees, officers, interns, and directors of Sponsors or their affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live), or persons living in the same households of such individuals, whether or not related, are not eligible to enter or win a prize. Further, minors, and those living in jurisdictions where participation is prohibited by law, are ineligible.
HOW TO ENTER
Send an email to with the following information:
1) Your full name,
2) Your age as of March 5, 2018, and
3) Your contact information, including your email, phone number and address.
Please separately, and individually, attach to your email the following:
1) A photo you personally shot and edited. ONLY ONE PHOTO AND ONLY ONE SUBMISSION ARE PERMITTED.
2) An essay of 200-500 words in Chinese or English that explains and gives background about the particularly touching beautiful moment depicted in the photo. The essay and the photo are each worth 50% of the overall score.
3) A short description of how the photo was shot and edited, such as the location, time of day, camera type, shutter speed, aperture, editing software used, etc.
The photo must be attached to the email submission and can be shot using any camera, cell phone or digital device. All submissions must be in JPEG/JPG format and the file size must be 15 megabytes or less, and must be at least 1,600 pixels wide (if a horizontal image) or 1,600 pixels tall (if a vertical image). Only one photo may be attached to each submission. Multiple submissions are not allowed. Images must be in accord with these Official Rules and all applicable laws. The image must be acceptable to general audiences, including families with young children, and the image must not violate the privacy or property rights of others. If a photo includes a person, Entrants may be required to provide a release from that person (or that person's parents if the photo is of a minor).
ENTRANTS GRANT ROYALTY-FREE, NON-EXCLUSIVE LICENSE TO REPRODUCE IMAGE
Entrants will retain all rights to any photos submitted; however, by submitting a photo, Entrants grant Sponsors and their respective successors, assigns and licensees, a royalty-free, non-exclusive license to reproduce, distribute, display, broadcast, post online, modify and create derivative works of the photo in connection with this contest, or the promotion or advertisement of this contest, in any media now, or hereafter, known.
THIRD PARTY RELEASES
Entrants are responsible for obtaining a signed release from all persons appearing in a photo (including the parents/guardians of minors appearing in a photo), and from the creators of artwork, or other copyrighted or trademarked materials appearing in a photo, authorizing Sponsors to reproduce, distribute, display, broadcast, modify and create derivative works in connection with this contest, in any media now, or hereafter, known. Entrants must provide, within seven calendar days of receipt of Sponsors' request, signed releases of anyone appearing in a photo, or from the owners of copyrighted or trademarked material appearing in a submitted photo. Failure to provide such releases upon request may result in disqualification and the selection of an alternate winner.
SPONSORS MAY REQUEST FURTHER DOCUMENTATION
Sponsors may reasonably require further documentation in order to evidence or effectuate the rights granted in these Official Rules. If a request for documents is made, Entrants agree to sign, authenticate and deliver the same within five days. Should a winner make any false statement(s) in any documents referenced herein, the winner will be required to promptly return an awarded prize to Sponsors.
An entry is void if Sponsors determine the entry is not original, or if the entry is illegible, incomplete, damaged, counterfeit, or obtained through fraud or theft, including copying an image from any other online or offline source that is not the author's own. No mechanically reproduced, forged, software-generated, or automated entries will be accepted. The submission of multiple entries will result in disqualification. Additional restrictions not contained in these Official Rules may apply.
Multiple submissions, plagiarized writing, photos that infringe upon another person's rights, photos that contain obscene, libelous or otherwise objectionable material, photos that involve putting any individual or animal in danger, or photos that are submitted outside of the Entry Period, are ineligible. Sponsors' computers will be the official timekeeper for this contest. Sponsors reserve the right to disqualify any entry they deem to be ineligible. Submissions will not be individually acknowledged.
Entrants acknowledge and agree that Sponsors have no duty or liability, present or future, direct or indirect, or otherwise, with respect to the infringement or protection of the copyright in and to the entry.
A panel of judges consisting of professionals and experts from the fields of photography, television, film or literature, and chosen at Sponsors' sole discretion, will choose the winners. The judges will score the quality, creativity and technical skill displayed in both the photo and the essay. The photo and the essay will each account for 50% of the overall score.
Judges will first choose the top fifty winners, using the criteria above, from all eligible submissions.
Judges will then choose the top ten winners from among the top fifty winners, using the same criteria.
Judges will then choose the top three winners, including the respective placement of first, second or third place, from among the top ten winners, using the same criteria.
Ties will be broken by a vote of Judges. A potential winner must sign and return all required documentation before being declared an official winner. Entrants may not amend, supplement, edit, or otherwise alter their entry once it has been submitted. Judges' decisions are final and may not be appealed. Please do not contact Sponsors regarding the status of your submission.
TOP FIFTY WINNERS
The top fifty winners will be notified by email, using the information provided with their submission, and their names and cities of residence will be posted online at www.primetimetv.org, on or about May 28, 2018. The top fifty winners will be awarded a Certificate of Excellence. This certificate will be placed in the mail no later than July 15, 2018; however, the date of delivery cannot be guaranteed.
TOP TEN WINNERS
The names and cities of residence of the top ten winners, as chosen from among the top fifty winners, will be posted on the LA Primetime TV website at www.primetimetv.org, on or about June 5, 2018. In addition to a Certificate of Excellence, the top ten winners will receive a “Top 10” trophy and a cash prize of $200 (unless they are awarded one of the top three prizes described below). Each of the top 10 winners will also be invited as guests of honor to the AHMC Health Foundation Gala to be held on June 23, 2018 in Los Angeles. The top 3 winners will be announced in a special awards recognition ceremony during this event. Transportation and accommodations will not be provided. All prizes will be awarded no later than July 15, 2018.
TOP THREE WINNERS
The top three winners will be chosen from among the top ten winners, and their respective placement of first, second or third place will be decided, on or about June 15, 2018. As discussed above, the top three winners will be announced at the awards recognition ceremony to be held on June 23, 2018 during the AHMC Health Foundation Gala. The names and cities of residence of the top three winners will be posted online at www.primetimetv.org on or about June 25, 2018. The top three winners will receive a Certificate of Excellence, a trophy indicating their placement of first, second or third place, and one of the following cash prizes:
First Place - $5,000 Second Place - $2,000 Third Place - $1,000
Sponsors shall have no liability for any notification that is not received by a potential winner for any reason. If, despite reasonable efforts, a potential prize winner does not respond within five days of the first notification attempt, or if a prize is returned as unclaimed or undeliverable to a potential prize winner, such potential prize winner may forfeit their prize and an alternate prize winner may be selected at Sponsors' discretion. If any potential prize winner is found to be ineligible or declines a prize for any reason, an alternate winner may be selected. Sponsors may successively attempt to contact up to two potential prize winners in accordance with such procedure, and if there is still no confirmed prize winner after such attempts have been made, the applicable prize may go unawarded.
SHARING OF ENTRANTS' PERSONAL INFORMATION
The information contained in Entrants' emails will necessarily be shared among the entities administering this contest to verify eligibility and to contact potential winners. Individuals who do not want to share their personal information in this way should not enter this contest.
ENFORCEABILITY OF RULES
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision in these Official Rules is determined to be invalid or unenforceable, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid provision were not contained herein.
Issues concerning the construction, validity, and interpretation of these Official Rules, or the rights and obligations of Entrants or Sponsors, shall be governed by and construed in accordance with the laws of the United States and the internal laws of California without giving effect to any choice of law or conflict of law rules that would cause the application of any other jurisdiction's laws.
WAIVER OF EQUITABLE RELIEF
Entrants agree that with respect to any claim arising out of actual or alleged exploitation or use of any material submitted in connection with this contest, the damage, if any, thereby caused to Entrants will not be irreparable or otherwise sufficient to entitle Entrants to seek injunctive or other equitable relief and Entrants' sole remedy is the right to recover damages, if any, in an action at law in the appropriate court in California.
RELEASE AND LIMITATIONS OF LIABILITY
Sponsors shall not be liable for any taxes owed by prize winners for prizes won.
Sponsors are not responsible for the transportation or accommodations of those attending the AHMC Health Foundation Gala.
Sponsors shall not be liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in this contest.
Sponsors have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the quality of any prize, or its fitness for a particular purpose.
Sponsors assume no responsibility for incomplete, illegible, misdirected, misprinted, late, damaged, stolen, or otherwise lost communications, notifications or prizes; or for interrupted, inaccessible or unavailable networks, Internet service providers, websites, or other connections; or for technical malfunctions or difficulties of any kind, or for the incorrect or inaccurate capture of information, or the failure to capture any information.
Sponsors cannot accurately predict the number of Entrants who will participate. Many will enter, few will win.
RESERVATION OF RIGHTS/FORCE MAJEURES
Sponsors reserve the right to reject any entry if, in Sponsors' sole discretion, the laws of an applicable jurisdiction would prohibit or limit Sponsors from proceeding with this contest as intended, or the awarding of any prize would impose additional administrative, tax, operational, or legal burdens on Sponsors.
Sponsors reserve the right to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing this contest.
Sponsors reserve the right to modify, extend, suspend, or terminate this contest if an insufficient number of eligible entries are received and/or if Sponsors determine that this contest is technically impaired or corrupted, or that fraud or other causes beyond Sponsors' control have destroyed or impaired the integrity, administration, security, or feasibility of this contest as contemplated herein.
Sponsors reserve the right, at their sole discretion, to disqualify any individual who is found to have intentionally disrupted, tampered with, or otherwise undermined the legitimate operation of this contest, and to seek damages and other remedies from any such person to the fullest extent permitted by law.
Sponsors further reserve the right to modify, extend, suspend, or terminate this contest if Sponsors are prevented from awarding prizes or continuing with this contest as contemplated herein by any event beyond their control, including but not limited to fire, flood, natural or man-made disaster, equipment failure, or any law or order of any court or jurisdiction (each a “Force Majeure” event or occurrence).
CONTEST IS VOID WHERE PROHIBITED BY LAW
By entering, Entrants certify that their participation and receipt of prizes is not prohibited by the laws governing the jurisdiction of their residence. Individuals residing in any excluded jurisdiction are ineligible to enter. Excluded jurisdictions include those countries listed on the US Treasury Office of Foreign Assets Control (OFAC) Active Sanctions Programs list at https://sanctionssearch.ofac.treas.gov/.
ENTRANTS' REPRESENTATIONS AND WARRANTIES
Entrants represent and warrant as follows:
The entry is a wholly original, self-created, previously unpublished, and previously unproduced work.
The entry does not violate any applicable laws or these Official Rules.
The entry is not defamatory or libelous.
The entry does not violate or infringe the intellectual property rights or other rights of any third party.
The use of the entry as set forth herein will not give rise to any claims for any payment whatsoever.
Entrants agree to indemnify and hold Sponsors, and all other entities involved in the administration of this contest, including, but not limited to, Arcadia Medical & Cosmetic Center (AMCC), LA Primetime TV, and all other entities involved in the administration of this contest, harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations, covenants, obligations or agreements hereunder.
